Familiarity and Compliance with Regulatory Requirements
Grace Manor and its employees, professional staff members, and contractors are subject to numerous federal and state regulatory requirements relating to the provision of health care services by Grace Manor, and the submission of claims for payment for such health care services on behalf of Grace Manor.
- Employees and contractors of Grace Manor, and members of all Grace Manor professional staffs, are expected to be familiar with and to comply with the applicable federal and state regulatory requirements.
- Employees, professional staff members, and contractors also are expected to be familiar with the penalties for failure to comply with such requirements.
- Any questions regarding federal or state regulatory requirements should be directed to the Compliance Officer.
Familiarity and Compliance with Regulatory Information
- From time to time, Grace Manor will distribute written information and/or provide in-house training sessions regarding federal and state regulatory compliance issues relating to the provision of health care services by Grace Manor, or reimbursement by government health care programs for such services.
- These issues will include those that are identified as a result of internal audit and monitoring activities, or identified as potential areas of concern by the Centers for Medicare & Medicaid Services (CMS), the Office of inspector General of the Department of Health and Human Services ("OIG"), or other federal or state government agencies.
- Employees, professional staff members, and contractors should review such information and address any questions to the Compliance Officer.
Licenses, Certifications, Approvals and Accreditations
- Grace Manor maintains all licenses, certifications, approvals and accreditations necessary for the operation of each health care facility, service, or department within Grace Manor.
- In addition, Grace Manor will comply with all applicable requirements for participation in government health care programs, including Medicare and Medicaid, and private health insurance plans to which claims or requests for payment for health care services are submitted on behalf of Grace Manor.
Antitrust Laws
- It is the policy of Grace Manor to comply fully with federal and state antitrust laws and regulations.
- Employees of Grace Manor may not enter into agreements or understandings with a competitor that unlawfully limit or restrict competition.
- This policy applies not only to express, formal and written agreements but also to implied, informal, and oral agreements.
- When purchasing goods or services for Grace Manor employees may not enter into agreements or understandings that unlawfully limit or restrict purchasing decisions of Grace Manor.
- For example, no employee of Grace Manor may agree with other health care systems or providers to boycott a given supplier or to pay no more than a given amount for some good or service.
Laws Relating to Tax-Exempt Status
It is the policy of Grace Manor to comply fully with all federal and state tax laws and regulations and to preserve the tax exempt status of Grace Manor.
- Grace Manor will conduct its operations in such a manner as to further the charitable purposes of Grace Manor and to enable the resources of Grace Manor to be used for the benefit of the community, rather than the private interests of any individual within Grace Manor.
- Grace Manor and its employees will avoid compensation arrangements or other transactions in excess of fair market value that might jeopardize the tax exempt status of Grace Manor.
- All tax information and tax returns will be filed in accordance with applicable law.
